Terms of Service

Welcome to Neervo. By creating an account, accessing, or using our platform — whether on our website at neervo.com, our mobile applications, or any related services (collectively, the "Platform") — you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or policies we publish.

Neervo Inc. ("Neervo", "we", "us", "our") operates an online marketplace that connects individuals who want to rent private pools and outdoor spaces by the hour ("Guests") with property owners who list those spaces ("Hosts"). We are not a rental company — we provide the technology platform that facilitates these connections.

If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including visitors, Guests, Hosts, and anyone else who accesses the Platform.

Age requirement. You must be at least 18 years old to use Neervo. If you are between 13 and 18, you may only use the Platform under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

Legal capacity. You represent that you have the legal capacity to enter into a binding contract, are not prohibited from using our services under applicable law, and have not been previously banned from the Platform.

Accurate information. You agree to provide accurate, complete, and current information when creating your account and to keep that information up to date. Providing false information is grounds for immediate account termination.

One account per person. You may maintain only one active account. Creating multiple accounts to circumvent restrictions is prohibited.

What Neervo does: We provide the technology platform — website, mobile app, search, booking, messaging, and payment infrastructure — that enables Guests and Hosts to find each other and transact. Our role ends at facilitating the connection and processing the payment.

What Neervo does not do: Neervo does not own, lease, rent, control, manage, inspect, maintain, or operate any pool or space listed on the platform. We do not employ Hosts, set their rates, or dictate their house rules. We do not vet the physical safety or legal compliance of listed spaces beyond requiring Hosts to self-certify compliance. We are not an insurer or guarantor of any booking.

Independent Host relationship. Hosts are fully independent third-party property owners. They are not Neervo employees, contractors, agents, partners, joint venture partners, or franchisees. Neervo has no right to control how a Host manages, maintains, or presents their property.

Guest responsibility. Guests enter into a direct agreement with the Host when they complete a booking. Guests are responsible for: reviewing the listing before booking; communicating with the Host about any questions; using the space appropriately and safely; following all posted house rules; and supervising all members of their group, especially minors.

Host responsibility. Hosts are fully responsible for: the accuracy of their listing; the safety and legal compliance of their property; obtaining any required permits or HOA approvals; carrying appropriate insurance; and the conduct of all activities at their property during and after bookings.

Listing accuracy. Neervo requires Hosts to provide accurate information but does not independently verify every listing. We encourage Guests to review all listing details carefully and contact Hosts with questions before booking.

Booking and confirmation. When you submit a booking request, you are making an offer to rent the listed space under the Host's stated terms. For Instant Book listings, your booking is confirmed and payment charged immediately. For Request-to-Book listings, your booking is pending until the Host approves; if the Host does not respond within 24 hours, the request expires automatically.

Your obligations as a Guest. You agree to:

• Arrive at the scheduled start time and depart by the scheduled end time
• Comply with all house rules posted by the Host
• Treat the property, pool, and all equipment with reasonable care
• Not exceed the guest count stated in your booking
• Not use the space for any purpose other than lawful recreational use
• Supervise minors in your group at all times, especially near water
• Report any damage, safety issues, or incidents to Neervo promptly
• Not bring animals unless the Host has explicitly permitted them

Damage. You are responsible for any damage caused to the Host's property, pool, or equipment during your booking beyond normal wear and tear. Neervo may charge the payment method on file for documented damage at the Host's request, subject to our dispute process.

Swimming safety. You acknowledge that swimming and water activities involve inherent risks, including risk of injury or death. You assume all risk associated with water activities and agree that Neervo bears no responsibility for any aquatic incident.

Assumption of risk. You voluntarily accept all risks associated with using the listed space, including but not limited to slipping, water hazards, pool equipment, and outdoor conditions.

Listing requirements. By creating a listing, you represent and warrant that: (a) you have the legal right to list and rent the space; (b) you have obtained any required permits, licenses, or HOA approvals; (c) your listing description, photos, and pricing are accurate; (d) your pool or space meets all applicable health, safety, and building codes; and (e) you have appropriate liability insurance or accept full responsibility for uninsured losses.

Your obligations as a Host. You agree to:

• Maintain the listed space in a safe, clean, and functional condition
• Honour all confirmed bookings except in cases of genuine emergency
• Respond to booking requests within 24 hours
• Keep your availability calendar accurate to avoid double-booking
• Provide Guests with complete and accurate access instructions before the booking
• Disclose any safety hazards, equipment issues, or changes to the space
• Comply with all applicable local, state, and federal laws and regulations

Tax compliance. You are solely responsible for determining and fulfilling your tax obligations on income earned through Neervo, including income tax, occupancy tax, sales tax, or any other applicable taxes. Neervo may issue applicable tax forms where required by law.

Insurance. Neervo does not provide insurance for hosted properties. You are strongly advised to review your homeowner's or renter's insurance policy and obtain additional coverage appropriate for short-term commercial rental activity. Many standard policies exclude commercial activities.

Host cancellations. Hosts who cancel confirmed bookings without legitimate cause may be subject to penalties including reduced listing visibility, temporary suspension, or removal from the Platform.

Payment processing. All payments are processed by Stripe, Inc., a third-party payment processor. By using Neervo, you agree to Stripe's terms of service and privacy policy. Neervo does not store full card numbers — payment data is encrypted and handled directly by Stripe.

Guest service fee. Neervo charges Guests a service fee of approximately 15% of the booking subtotal, calculated at checkout. This fee covers platform operations, payment processing, and customer support. The exact fee is always displayed before you confirm a booking — there are no hidden charges.

Host payout. Hosts receive approximately 80% of the booking subtotal after Neervo's host service fee is deducted. The exact payout amount is shown in your earnings dashboard before you accept bookings. Payouts are disbursed via Stripe Connect to your connected bank account 24–48 hours after each session ends, subject to Stripe's processing times.

Currency. All prices are displayed and charged in US dollars (USD).

Authorization holds. For some bookings, Neervo may place an authorization hold on your payment method before charging. This hold is released if the booking is declined or cancelled before charging.

Pricing accuracy. Neervo is not responsible for pricing errors in listings. In the event of a manifest pricing error, Neervo reserves the right to cancel the affected booking and issue a full refund.

Guest cancellations. Refunds depend on the cancellation policy chosen by the Host for their specific listing. All Neervo listings use one of three standard policies:

All times are measured from the booking start time in the listing's local timezone. Platform service fees are non-refundable regardless of cancellation policy.

Host cancellations. If a Host cancels a confirmed booking, Guests receive a full refund including platform service fees. Neervo may also issue a courtesy credit at its discretion.

Extenuating circumstances. Neervo may override standard policies in genuine extenuating circumstances including natural disasters, declared public health emergencies, government travel restrictions, or death of a Guest or immediate family member. Documentation is required. Neervo's determination is final.

Refund processing. Approved refunds are initiated within 1–2 business days. Your bank or card issuer may take 5–10 additional business days to post the credit.

You may not use Neervo to:

• Violate any applicable law, ordinance, regulation, or third-party rights
• Discriminate against any user based on race, colour, national origin, religion, sex, gender identity, sexual orientation, disability, familial status, or any other protected characteristic under the Fair Housing Act or applicable law
• Harass, threaten, intimidate, stalk, or abuse any other user
• Post false, misleading, defamatory, or fraudulent listings, reviews, or communications
• Circumvent our payment system — all transactions must go through Neervo's platform
• Solicit personal contact information or attempt to move transactions off-platform
• Use the platform to facilitate illegal activities including drug use, underage drinking, or unlicensed commercial events
• Scrape, crawl, or use automated tools to access our platform without written permission
• Create fake accounts, manipulate reviews, or abuse our trust systems
• Rent a space you do not have the legal right to list
• Exceed maximum guest counts, noise ordinances, or community rules
• Engage in commercial filming, photography, or production without the Host's explicit written consent

Enforcement. Violations may result in content removal, account suspension, permanent ban, and where warranted, referral to law enforcement. Neervo may pursue civil damages for platform misuse.

Your content. By posting photos, descriptions, reviews, messages, or any other content on Neervo ("User Content"), you grant Neervo a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish, distribute, and display that content in connection with operating and promoting the Platform.

Your responsibility. You are solely responsible for all content you post. You represent that you own or have the right to share all content you upload, and that your content does not violate any third-party rights or applicable law.

Reviews. Reviews must be genuine and based on actual booking experience. Incentivised, fake, or retaliatory reviews are prohibited. Neervo may remove reviews that violate this policy. We use a double-blind system — neither party sees the other's review until both have submitted or the review period closes.

Our rights. Neervo may remove any User Content at any time for any reason, including content that violates these Terms or that we determine in our sole discretion is harmful to the Platform community.

No warranties. The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

Liability cap. To the maximum extent permitted by law, Neervo's total cumulative liability to you for any claims arising from or related to these Terms or the Platform is limited to the greater of: (a) the total fees paid by you to Neervo in the 12 months preceding the claim, or (b) USD $100.

Excluded damages. In no event shall Neervo be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — even if Neervo has been advised of the possibility of such damages.

Third-party acts. Neervo is not liable for the acts or omissions of Hosts, Guests, or any third party. We do not control and are not responsible for the quality, safety, legality, or suitability of any listed space.

Aquatic incidents. Neervo expressly disclaims all liability for any injury, illness, or death related to swimming, water activities, or any use of pools or water features listed on the Platform. Users participate in water activities entirely at their own risk.

Some jurisdictions do not allow certain liability limitations. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless Neervo, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Platform or participation in any booking
• Your violation of these Terms or any applicable law
• Your User Content
• Any injury, loss, or damage occurring at a listed space during your booking
• Any dispute between you and another user

Neervo reserves the right to assume control of the defence of any matter subject to indemnification by you, at your expense.

Informal resolution first. Before filing any formal claim, you agree to contact Neervo at legal@neervo.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the issue within 30 days.

Binding arbitration. If informal resolution fails, you and Neervo agree that any dispute, claim, or controversy arising from or relating to these Terms or the Platform shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English in Wilmington, Delaware, or by remote means if mutually agreed. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Neervo each waive the right to a jury trial and to participate in any class action, class arbitration, or representative proceeding. All disputes must be arbitrated or litigated on an individual basis only.

Exceptions. Either party may seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights or to stop imminent irreparable harm. Small claims court actions within applicable jurisdictional limits are also exempt from the arbitration requirement.

Opt-out. You may opt out of arbitration by sending written notice to legal@neervo.com within 30 days of first accepting these Terms. Your opt-out notice must include your name, email address, and a statement that you wish to opt out of arbitration.

Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles, except where arbitration rules or applicable consumer protection law require otherwise.

Statute of limitations. Any claim against Neervo must be filed within one year of the event giving rise to the claim, or it is permanently barred.

By you. You may close your account at any time via Profile → Danger zone → Delete account. Pending confirmed bookings will be honoured or cancelled according to applicable policy before closure.

By Neervo. We may suspend or terminate your access to the Platform immediately, without notice, for: (a) material violation of these Terms; (b) fraudulent, harmful, or illegal conduct; (c) creating safety risks for other users; or (d) any other reason at our sole discretion where continued access would be harmful to the Platform community.

Effect of termination. Upon termination, your licence to use the Platform ends immediately. Provisions that by their nature should survive termination — including liability, indemnification, dispute resolution, and governing law — shall survive.

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you by email or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
